Can Local Management enter into an MOA
Local management has the authority to enter into an MOA at the local level. Recently the Bangor, ME. RADAR SSC Representative was notified by management via Article 69 of a change in working conditions that impacted the RADAR Specialists at that facility. The Union Rep. and local management negotiated the impacts and came to several agreements regarding the impacts. The Union rep. then presented management with an MOA that reflected the agreed upon issues. Management refused to sign the MOA saying that local management did not have the authority to sign such a document. The PASS Rep then filed a ULP and the FLRA ruled that based on Article 69 the Agency must sign the MOA. The result is a posting that resulted from a settlement agreement.
